Terms & Conditions for Kaboompics
1. Introduction
This document outlines the terms under which you may access and use the website, including rules regarding image usage, limitations of liability, prohibited activities, and dispute resolution procedures. By accessing or using the website, you agree to these Terms & Conditions. If you do not agree with any part of these Terms, please do not use the website.
2. Use of the Website
You may browse, download, and use the images available on Kaboompics according to the applicable license terms.
You agree not to use the website for any unlawful purpose or in violation of these Terms.
3. Intellectual Property Rights
All images on Kaboompics are created and owned by Karolina Grabowska and are protected by copyright laws.

You may not claim ownership of the images or redistribute them as your own.
Kaboompics does not sell copyrights to the images; users receive a right to use them as defined by the license.
4. License to Images
One of the key features of Kaboompics is that it allows users to search, view, and download high-quality images (“Images”). You may download and use Images from Kaboompics in accordance with, and subject to, the Kaboompics License. We encourage you to familiarize yourself with the Kaboompics License, as well as the accompanying FAQs. Here’s a summary of the main license terms:
Kaboompics grants you an irrevocable, nonexclusive, worldwide copyright license to download, copy, modify, distribute, and use images from Kaboompics for free, including for commercial purposes, without permission from or attribution to the photographer or Kaboompics. However, this license does not include the right to compile images from Kaboompics to create a similar or competing service.
This means that the Images on Kaboompics come with a very broad copyright license under the Kaboompics License. However, this license does not include the right to use:
Trademarks, logos, or brands that appear in the Images.
People’s likenesses if they are recognizable in the Images.
Works of art, architecture, or design that appear in the Images.
If you download Images that contain any of these elements, you may need the permission of the brand owner, the rights holder of the work of authorship, or the individual depicted, depending on how you use the Image. Kaboompics is not liable for any damages, losses, or consequences resulting from the use of images on the site, except in cases where liability cannot be legally excluded under applicable laws.
In jurisdictions where limitation of liability is restricted, Kaboompics' liability shall be limited to the maximum extent permitted by law.
5. Images Containing People
All images featuring people on Kaboompics are legally compliant and have model releases.
Such images may be used for commercial purposes, but they cannot be used in a way that implies endorsement, participation, or recommendation by the person depicted.

Users are prohibited from using these images in sensitive, misleading, defamatory, or unethical contexts, including but not limited to:
Promotion of political, religious, or controversial agendas without explicit consent.
Association with illegal, harmful, or exploitative activities.
Use in adult, pornographic, or sexually explicit content.
Depiction of individuals in a derogatory or offensive manner.
If the author of the image or the model objects to the way an image is being used, Kaboompics reserves the right to challenge and request discontinuation of that usage.
6. Prohibition of AI Usage
Images from Kaboompics may not be used to train, develop, or enhance artificial intelligence (AI) systems, including generative AI models.
Uploading images to AI-powered tools for modification, analysis, or generation of new content based on them is strictly prohibited.
Images cannot be used for deepfakes, synthetic characters, or any AI applications that could violate copyrights, image rights, or lead to misinformation.
Kaboompics reserves the right to take legal action against entities or individuals violating this rule.
7. Kaboompics Shop – Premium Content
Kaboompics Shop is a section of the website offering premium content, such as exclusive photos, videos, and mockups.
All purchases in Kaboompics Shop are processed through Gumroad, a third-party payment provider.
Payments, file delivery, and refund policies are governed by Gumroad’s Terms & Conditions. Kaboompics does not process or store payment information.
Purchased digital files are non-refundable unless otherwise specified by Gumroad or applicable laws.
Users must review the specific license terms applicable to purchased content before use.

8. Kaboompics Secret Club & Newsletter
Kaboompics Secret Club is an exclusive section accessible only to subscribers of the Kaboompics newsletter.
By subscribing to the newsletter, users automatically gain access to the Secret Club, where they can download additional free resources, such as extra photos and mockups.
Subscription to the newsletter means users agree to receive email updates about new resources, special offers, and Kaboompics updates.
Users can unsubscribe at any time, which will automatically revoke access to the Secret Club.
Kaboompics reserves the right to modify or discontinue the Secret Club and newsletter terms at any time.
9. Age Restrictions
Kaboompics is intended for users aged 16 and older. If you are under 16, you may only use this website with the consent of a parent or legal guardian.
Kaboompics does not knowingly collect personal data from children under 16. If we become aware that such data has been collected without parental consent, we will take steps to delete it.
10. Prohibited Conduct
Users of Kaboompics agree not to engage in the following prohibited activities:
Using images or other content from Kaboompics in any unlawful, misleading, defamatory, or offensive manner.
Claiming ownership of images or redistributing them as part of another stock photography platform.
Using images in ways that violate the rights of third parties, including but not limited to copyright, trademark, and privacy rights.
Uploading Kaboompics images to AI tools, databases, or platforms for AI training, enhancement, or modification.
Attempting to disrupt, hack, or interfere with the normal functioning of the Kaboompics website.
Engaging in activities that violate any applicable laws or regulations.
Misrepresenting an association with Kaboompics, including falsely implying sponsorship, endorsement, or partnership.
11. Disclaimer & No Warranties
Kaboompics provides all images and content on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Kaboompics makes no representations or guarantees regarding the accuracy, reliability, or completeness of the images and does not warrant that they will be free from defects, errors, or legal restrictions in all contexts. Users bear full responsibility for ensuring that their use of the images complies with all applicable laws, including but not limited to intellectual property, privacy, and commercial usage rights. Kaboompics disclaims all liability for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the images or website. By using Kaboompics, users acknowledge and accept full responsibility for any consequences arising from their use of the images and content provided on the platform.
12. Limitation of Liability
Kaboompics provides images "as is" without any warranties, express or implied, regarding their suitability for any particular purpose. Users acknowledge that they download and use the images at their own risk.
While Kaboompics ensures that all images comply with legal requirements at the time of publication, it does not assume responsibility for how users utilize them. To the maximum extent permitted by law, Kaboompics shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the website or its content. This includes, but is not limited to, financial losses, business interruptions, reputational damage, or legal disputes resulting from the use of images.
Users acknowledge that they are solely responsible for their use of the images and agree to indemnify and hold harmless Kaboompics against any claims, damages, or legal actions resulting from their usage. Kaboompics does not accept liability for any third-party services, such as payment processing through Gumroad, and shall not be held responsible for any issues arising from transactions made via external platforms.
13. Governing Law, Dispute Resolution, and Arbitration
These Terms & Conditions shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles. Any disputes arising out of or in connection with the use of Kaboompics, including but not limited to claims relating to the interpretation, breach, or enforcement of these Terms, shall first be resolved through good faith negotiations between the parties. If a resolution cannot be reached, such disputes shall be subject to the exclusive jurisdiction of the competent courts in Poland.
Kaboompics reserves the right to seek injunctive or equitable relief in any jurisdiction where such action is necessary to protect its intellectual property rights or enforce these Terms & Conditions. By using the website, you expressly agree to submit to the jurisdiction of the Polish courts and waive any objections based on venue or inconvenient forum.- These Terms & Conditions are governed by and interpreted in accordance with the laws of Poland, without regard to conflict of law principles.
